Can a company in bankruptcy still license its data to AI labs?
Learn why bankruptcy blocks data licensing, what labs need, and how to move forward if you can get court approval.

If your company is in an assignment for the benefit of creditors or a Chapter 7 bankruptcy, you cannot license its data to AI labs until the case is closed. Bankruptcy places the data under the estate's control, so any sale or license needs court or trustee approval.
Why bankruptcy matters for data licensing
Bankruptcy law treats data as an asset of the estate. In an assignment for the benefit of creditors, a third-party assignee steps in to manage or sell assets to repay debts. In a Chapter 7 case, a trustee takes control of every asset and liquidates it. In both scenarios the estate must keep the asset pool intact for the creditors.
Because of that, a data license without explicit court or trustee sign-off would breach the estate's duties and could be undone later. AI labs also shy away from such deals. They need a clean chain of title, proof that the seller owns the data outright and can grant unrestricted rights. A bankruptcy interrupts that chain, so labs typically refuse to sign a license that could be challenged.
What AI labs look for
The most valuable data sets show a complete workflow from request to outcome. Labs focus on operational data that captures real business decisions and actions. The typical categories include:
- Support tickets that contain the initial request, troubleshooting steps, and final resolution.
- Chat threads where a decision was reached, including the prompts and responses.
- Customer-relationship-management activity and sales logs that trace a deal from lead to close.
- Standard operating procedures and internal documentation that define how work is performed.
- Knowledge-base articles and quality-assurance records that reflect problem-solving patterns.
- Project histories and accounting exports that reveal timelines, costs, and outcomes.
The price of a data set depends on volume, data type, years of continuous history on the same tools, and the rarity of the industry. Clean rights and the ability to strip personally identifiable information (PII) add premium value.
How our broker process works
We act as the bridge between you and interested AI labs. The first step is a short questionnaire about your company and the data you own. You do not send any raw data at this stage. We turn your answers into a one-page summary and share it with a handful of vetted labs.
Each lab returns a quote and the conditions it would accept. We bring the best offer back to you, and you decide whether to negotiate. No contract is signed and no data moves until you give the green light.
If you proceed, we handle the export securely and de-identify the data. All PII and any information your policies label as confidential are removed. Names become stable pseudonyms such as "employee 632." Our team runs automated de-identification tools and then a trained reviewer checks the result. The exact handling of raw files and the deletion schedule are negotiated case-by-case, and you will see a sample before any final acceptance.
Legal checks are performed on every data set. You must own the data, your customer contracts must permit de-identified use, and the data must be capable of having PII removed. Counsel on both sides reviews the license. Licenses are never perpetual; most buyers ask for a 24-month exclusive period, though a shorter term can be arranged for a lower price. You keep ownership of the data and can continue to use it internally.
Our advisory fee is payable only when a deal closes, and the buyer pays a finder's fee at that time. There is no upfront cost for you.
When a distressed company might still be eligible
In rare cases a trustee or assignee may determine that a particular data set is not needed to satisfy creditor claims and can be licensed as a separate transaction. That decision usually follows one of three conditions:
- The data set is unrelated to the core assets being liquidated.
- A court order explicitly permits the license.
- The license proceeds generate cash that can be distributed to creditors.
If you find yourself in such a situation, you will need a written order from the trustee or the court before any negotiation can begin. The order must state that the data can be licensed, outline the license terms, and specify how the proceeds will be allocated to the estate. Only after that approval can we start the broker process.
Your next step
If your company has at least thirty full-time employees, owns the data outright, and is not currently restricted by a bankruptcy proceeding, you can see whether you qualify for our data-licensing service. Click the button below to start the quick eligibility questionnaire.
If you are in an assignment for the benefit of creditors or a Chapter 7 case, the first move is to obtain a court or trustee order that permits a data license. Once you have that, come back to us and we'll take it from there.
Questions people ask
Can I license data while bankruptcy is still pending?
Only with a specific court or trustee order that authorizes the license. Without that, the data stays part of the estate and cannot be transferred.
Do I have to sell the data outright?
No. You license the data, which means you keep ownership and can continue to use it internally. Licenses are typically for a limited term.
How long does the de-identification process take?
The timeline depends on the size and complexity of the data set and on the method agreed in the contract. Our team works to meet the schedule you set.
What if my company has fewer than thirty employees?
We currently work only with companies that have thirty or more full-time staff. Smaller firms may explore partnering with a larger affiliate that meets the requirement.
